Whenever they say they have the right to assemble, they quote Article 10 (1) (a) of the Federal Constitution of Malaysia. What they never quote is Article 10 (2) (a) of the Constitution that says:
"Parliament may by law impose such restrictions as it deems necessary or expedient in the interest of the security of the Federation or part thereof, friendly relations with other countries, PUBLIC ORDER or morality, and restrictions designed to protect the Privileges of Parliament, or of any Legislative Assembly, or to provide against contempt of court, defamation, OR INCITEMENT TO ANY OFFENCE."
By virtue of public order, the authorities have the right provided by the Constitution to prevent them from assembling, or to direct them to assemble at somewhere safer for every party - such as in a stadium.
Since AMBIGA has asked people to continue to rally citing Article 10 (1) (a), she has committed an offence described in Article 10 (2) (a) ... INCITEMENT TO ANY OFFENCE by asking people to assemble illegally.
